Cagatay Koc

Cagatay Koc is an Executive Vice President with Compass Lexecon based in Washington, DC. Dr. Koc’s primary areas of focus are antitrust litigation, merger reviews, damages, and valuation analyses, with expertise in the health care and energy industries.

Dr. Koc has more than 20 years of experience consulting with counsel on economic issues, identifying experts, working with experts to prepare reports, and deposition and trial support. He also has provided expert testimony in cases involving collusion, alleged overcharges, damages, and energy valuations.

Dr. Koc has addressed class certification, liability and damages issues in matters involving allegations of monopolization, exclusionary conduct, price fixing, and bid rigging in a variety of industries, including hospital services, health insurance, pharmaceuticals, private equity, auto parts, and energy. He has analyzed the competitive effects of mergers and issues of market definition in diverse industries, including hospital services, physician services, health insurance, pharmaceuticals, energy, and consumer products. He also has conducted economic analysis for matters involving issues at the intersection of finance and antitrust.

Dr. Koc has provided damages and valuation analyses in several reimbursement rates disputes between health care providers and large health insurance companies.  He has also provided damages and valuation analysis in false advertising, trade secrets, breach of contract, defamation, employment termination, and insurance disputes. Issues he has addressed in damages analysis include establishing causation, the appropriate measure of damage, estimation of appropriate discount rate, estimation of conditions in the “but for” world, and evaluation of mitigation.

Dr. Koc has also analyzed valuation issues in connection with appraisal actions, proxy statement misrepresentation and omission claims related to the value of the assets of merger transactions, material adverse change (MAC) disputes, and the analysis of specific assets such as spectrum holdings and oil and gas assets.

Prior to joining Compass Lexecon, Dr. Koc was a Managing Director at Economists Incorporated / Secretariat Economists, had been a visiting scholar at the Federal Trade Commission (Bureau of Economics), and taught economics at Columbia University and University of Texas at Arlington. Dr. Koc has published numerous articles in academic research journals such as the Journal of Health Economics, Health Economics, Journal of Risk and Insurance, Journal of Urban Economics, and Journal of Real Estate Finance and Economics.
